Subclass 186

• A permanent visa allowing skilled workers to stay, live, and work in Australia indefinitely.
• Applicants must be nominated by an approved Australian employer.
• Available through three streams:
• Temporary Residence Transition Stream (for those holding a 482/TSS visa)
• Direct Entry (DE) Stream (for those who meet skills assessment and experience requirements)
• Labour Agreement Stream (for those sponsored under a Labour Agreement)

Eligibility Criteria for ENS Visa

• Must be nominated by an approved Australian employer.
• Must have competent English (IELTS 6.0 equivalent or above).
• Must meet health and character requirements.
• Must have the necessary skills and qualifications relevant to the nominated occupation.
• TRT Stream: Must usually have worked for the employer for at least 2 years on a 482 visa.
• Direct Entry Stream: Must have a positive skills assessment and at least 3 years of relevant work experience.
• Age usually must be under 45 years at time of application (certain exemptions apply).

Responsibilities of the Sponsor (Employer)

• Must be an approved Standard Business Sponsor..
• Must nominate the employee for a valid occupation listed on the Medium and Long-term Strategic Skills List (MLTSSL)..
• Must offer a genuine full-time position for at least 2 years..
• Must meet salary and working conditions obligations (market salary rate).

Responsibilities of the Nominee (Employee)

• Must commit to working in the nominated position full-time for the sponsoring employer for at least 2 years..
• Must maintain compliance with visa conditions..
• Must genuinely intend to work for the sponsoring employer..

Is Labour Market Testing (LMT) Required for ENS Visa?

LMT is not mandatory under the Employer Nomination Scheme (Subclass 186). However, evidence of genuine need for the position and efforts to recruit Australians is generally recommended to strengthen the nomination.
